Community swimming pool dispute

Some friends of ours purchased an lovely apartment 8 years ago in a small, gated community in Nueva Andalucia.

Recent disputes within the community over gardens and maintenance have unearthed the fact that they, and a handful of neighbors, have no rights to use the community swimming pool!!
They have been thinking about selling the apartment to upgrade to a villa and now this has come to light, it will seriously affect the sale of their beautiful property.
We have never come across such nonsense! Who would even think to check that when buying an apartment?
There are not more than 25 apartments in all and it seems absolutely ludicrous that nearly half the community are for some reason blocked from having access.
Has anyone else come across this? would anyone even think to ask such a question when buying an apartment?
